Terms & Conditions

These terms form the agreement between you and Apport Distribution LLC and apply to our respective successors and assigns. You may not transfer or assign your rights and obligations under this agreement without our prior written consent. We may transfer or assign our rights and obligations at any time during the term of the agreement.

Events Outside Our Control:

We are not liable for failure or delay in fulfilling any of our obligations under this agreement caused by events outside our reasonable control, also known as a ‘Force Majeure Event’. Such events include, but are not limited to:

• Strikes, lock-outs, or industrial actions
• Civil commotion, riots, terrorist attacks, or threats
• War, natural disasters (fire, flood, storm, earthquake, etc.), or epidemics
• Disruptions to transport or telecommunications networks
• Government actions, decrees, or regulations

During such events, our performance is suspended, and we will be given extra time for delivery or performance. We will make reasonable efforts to end the Force Majeure Event and resume normal operations.

Waiver:

Failure to enforce any obligation under this agreement, or to exercise any rights, does not constitute a waiver of those rights or relieve you from compliance. A waiver will only be valid if it is communicated to you in writing.

Severability:

If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full effect.

Entire Agreement:

These Terms & Conditions and any other documents explicitly referenced in them constitute the entire agreement between us. While we may rely on statements from our agents, please request any variations to these terms in writing. We have the right to amend these Terms & Conditions to reflect changes in market conditions, technology, payment methods, legal requirements, or any other factors.

Changes to Terms:

You will be subject to the Terms & Conditions in effect at the time you place an order, unless otherwise notified. Any changes will be communicated to you before dispatch, and by continuing with the order, you accept these changes.

Contract Information and Governing Law:

A contract between you and Apport Distribution LLC is formed only when we confirm that your order has been dispatched and provide you with the order/dispatch number.
